微博朋友圈可作刑案證據(jù) 該規(guī)定將于10月1日起施行

Information posted by users on social media can be used as evidence if the contents are involved in related criminal cases, according to a regulation issued by China’s law enforcement authorities.

　　根據(jù)我國執(zhí)法機(jī)關(guān)近日發(fā)布的一項(xiàng)規(guī)定，若用戶在社交媒體上發(fā)布的信息涉嫌與刑事案件有關(guān)，則該內(nèi)容可作為證據(jù)。

　　The rule, co-formulated by the Supreme1 People’s Court, Supreme People’s Procuratorate and the Ministry2 of Public Security, is aimed at regulating the collection and review of digital data in criminal cases and will come into force on Oct 1.

　　這項(xiàng)規(guī)定由最高人民法院、最高人民檢察院、公安部三部門聯(lián)合制定，旨在規(guī)范刑事案件中電子數(shù)據(jù)的收集和審查。該規(guī)定將于10月1日開始施行。

　　Law enforcement authorities have the right to collect and retrieve3 digital data duringinvestigations4, the rule says.

　　規(guī)定稱，在調(diào)查期間，執(zhí)法機(jī)關(guān)有權(quán)收集、調(diào)取電子數(shù)據(jù)。

　　The data includes information posted on Weibo, WeChat, cloud storage platforms and other online platforms, as well as e-mails and cell phone messages.

　　這些數(shù)據(jù)包括在微博、微信、網(wǎng)盤等網(wǎng)絡(luò)平臺上發(fā)布的信息以及電子郵件和手機(jī)短信。

　　However, the collected and retrieved5 electronic data must be kept secret if it involves national and business secrets or personal information.

　　不過，收集、調(diào)取的電子數(shù)據(jù)若涉及國家秘密、商業(yè)秘密、個(gè)人隱私，則必須保密。

　　The related information could also be temporarily frozen if it is too large to be collected or has the danger of being tampered6 with or lost.

　　如果數(shù)據(jù)資源過大，短時(shí)間內(nèi)難以采集完成，或者數(shù)據(jù)有被篡改、丟失的危險(xiǎn)，那么執(zhí)法機(jī)關(guān)可以臨時(shí)凍結(jié)相關(guān)數(shù)據(jù)信息。

　　執(zhí)法機(jī)關(guān)已加大對網(wǎng)絡(luò)敲詐、詐騙和謠言的打擊查處力度。

　　China has experienced an increase in online fraud, particularly in the field of P2P lending, over the past year, a report published by online security company Liewang shows. There have been 24,886 reports of online fraud, up 7.96 percent from last year.

　　據(jù)網(wǎng)絡(luò)安全公司獵網(wǎng)平臺的報(bào)告顯示：同去年相比，中國網(wǎng)絡(luò)詐騙處于上升期，尤其是在P2P網(wǎng)絡(luò)借貸領(lǐng)域。已有24886起網(wǎng)絡(luò)詐騙見諸報(bào)道，同比上升7.96%。

　　A 19-year-old would-be freshman9 in Guangdong Province was defrauded10 of 9,800 yuan (1,470 USD) in a telephone scam in July, while a freshman-to-be and a college student, both in Shandong Province, died of heart attacks after they were defrauded of their money in August. Police later detained 28 suspects involved in the three telecom fraud cases.

　　今年7月，廣東一名19歲的待報(bào)到大學(xué)生，被一通電話騙走了9800元;8月份，山東省兩名準(zhǔn)大學(xué)生遭電信詐騙后心臟驟停猝死。警方隨后逮捕了3起電信詐騙的28名涉案嫌犯。
