中國(guó)就《數(shù)據(jù)安全管理辦法(征求意見(jiàn)稿)》征求公眾意見(jiàn)

China's Internet regulator started to solicit public opinions on data security regulation on Tuesday.

周二(5月28日)，國(guó)家網(wǎng)信辦開始就《數(shù)據(jù)安全管理辦法(征求意見(jiàn)稿)》，向社會(huì)公開征求意見(jiàn)。

According to a draft regulation released by the Cyberspace Administration of China, network operators must not force or mislead users to agree to the collection of their personal information on the pretext of improving service quality, enhancing user experience, sending customized push messages or developing new products.

根據(jù)征求意見(jiàn)稿，網(wǎng)絡(luò)運(yùn)營(yíng)商不得以提高服務(wù)質(zhì)量、增強(qiáng)用戶體驗(yàn)、發(fā)送定制推送信息或開發(fā)新產(chǎn)品為由，強(qiáng)迫或誤導(dǎo)用戶同意收集其個(gè)人信息。

The regulation applies to network-based collection, storage, transmission, processing and use of data, as well as data security protection and supervision in China, said the draft.

意見(jiàn)稿明確，這項(xiàng)規(guī)定適用于在中國(guó)境內(nèi)利用網(wǎng)絡(luò)開展的數(shù)據(jù)收集、存儲(chǔ)、傳輸、處理、使用等數(shù)據(jù)活動(dòng)，以及數(shù)據(jù)安全的保護(hù)和監(jiān)督管理。

The draft requires network operators to make and release the rules of data collection and usage via websites or applications. The operators must not provide discriminatory services to users based on whether they accept personal information collection and the collection scope.

意見(jiàn)稿要求網(wǎng)絡(luò)運(yùn)營(yíng)者通過(guò)網(wǎng)站、應(yīng)用程序等產(chǎn)品收集使用個(gè)人信息，應(yīng)當(dāng)分別制定并公開收集使用規(guī)則。經(jīng)營(yíng)者不得根據(jù)是否接受個(gè)人信息收集和收集范圍，向用戶提供歧視性服務(wù)。

The draft also requires operators to take remedial measures immediately when personal information leakage, damage, or loss happens, or when data security risks increase significantly.

意見(jiàn)稿還要求運(yùn)營(yíng)商在個(gè)人信息泄露、損壞或丟失或數(shù)據(jù)安全風(fēng)險(xiǎn)顯著增加時(shí)，應(yīng)當(dāng)立即采取補(bǔ)救措施。

The draft will be open for suggestions until June 28.
