Online shoppers should be granted a seven-day cooling-off period, within which they would be able to get a refund, a draft amendment presented to the legislature on Tuesday has proposed。
周四提交人大常委會審議的(消費者權(quán)益保護法)修正案草案提出,網(wǎng)購消費者應(yīng)享有七天的“后悔期”,在此期間,消費者有權(quán)退貨。
Cooling-off period字面意思為“冷靜期”,指消費者在購物之后的某個時間段內(nèi)有權(quán)要求退貨(return goods for a refund)或者取消交易(cancel a deal),所以也可稱為購物“后悔期”。另外,cooling-off period也可以指離婚前雙方的“冷靜期”。
該草案還提出,網(wǎng)絡(luò)經(jīng)營者在交易結(jié)束后不再使用交易平臺的,網(wǎng)購消費者(online shoppers)有權(quán)向網(wǎng)絡(luò)交易平臺(e-trade platforms)索賠(ask for compensation),網(wǎng)絡(luò)交易平臺提供者賠償后,有權(quán)向銷售者或者服務(wù)者追償。
該草案通過后將主要對商家對顧客式網(wǎng)店(business-to-consumer online store, B2C)及天貓等第三方交易平臺有約束作用,顧客對顧客式網(wǎng)店(consumer-to-consumer stores,C2C)因不在工商行政部門(business administration authorities)登記備案而無法受到有效約束。
