28部門出手 暴力傷醫(yī)和醫(yī)鬧將面臨聯(lián)合懲戒

10月16日，國家發(fā)改委官網(wǎng)公布由國家發(fā)改委、人民銀行、衛(wèi)生健康委、交通運輸部、民航局等20多個部門聯(lián)合簽署的《關(guān)于對嚴(yán)重危害正常醫(yī)療秩序的失信行為責(zé)任人實施聯(lián)合懲戒合作備忘錄》。

People who attack medical staff will be placed on a blacklist, according to a circular released by China's top economic planner on Tuesday that is designed to deter illegal acts targeting medical staff and institutions.

發(fā)改委16日發(fā)布文件打擊針對醫(yī)務(wù)人員和醫(yī)療機構(gòu)的違法行為，文件指出，對醫(yī)務(wù)人員有傷害行為者將被列入黑名單。

聯(lián)合懲戒對象是指因?qū)嵤┗騾⑴c涉醫(yī)違法犯罪活動(performing or involved in illegal acts related to medical staff or institutions)，被公安機關(guān)處以行政拘留(administrative detention)以上處罰，或被司法機關(guān)追究刑事責(zé)任(criminal punishment)的嚴(yán)重危害正常醫(yī)療秩序的自然人。

嚴(yán)重危害正常醫(yī)療秩序的失信行為包括：

purposefully injuring medical staff or damaging public and personal property in hospitals

在醫(yī)療機構(gòu)內(nèi)故意傷害醫(yī)務(wù)人員、損毀公私財物;

illegally restrict personal freedom of medical staff

非法限制醫(yī)務(wù)人員人身自由;

carrying guns, ammunition, restricted tools or hazardous items into hospitals illegally

非法攜帶槍支、彈藥、管制器具或危險物品進入醫(yī)療機構(gòu);

insulting and threatening medical staff

侮辱恐嚇醫(yī)務(wù)人員;

hospital appointment scalpers who seriously disrupt medical order

倒賣醫(yī)院號源等破壞、擾亂醫(yī)院正常診療秩序等。

對嚴(yán)重危害正常醫(yī)療秩序的失信行為責(zé)任人將實施跨部門聯(lián)合懲戒(joint punishment)。

懲戒措施包括：

restrictions in getting government subsidies

限制補貼性資金支持

restrictions in seeking government employment

限制招錄(聘)為公務(wù)員或事業(yè)單位工作人員

restrictions in high-end consumption and unnessary consumption such as traveling by planes, soft sleepers on trains, high-speed trains and first-class sections on other types of bullet trains

限制其乘坐飛機、列車軟臥、G 字頭動車組列車、其他動車組列車一等以上座位等高消費及其他非生活和工作必需的消費行為

information of such violators will be shared on national credit information sharing platform and their employers

將嚴(yán)重危害正常醫(yī)療秩序的失信行為人納入全國信用信息共享平臺并通報其所在單位等
