The regulation would ban online travel agencies from offering unreasonably cheap tour packages or using big-data analysis to price tour products to the disadvantage of existing customers.
暫行規(guī)定禁止在線旅游經(jīng)營者提供不合理低價團或者利用大數(shù)據(jù)“殺熟”。
所謂的“大數(shù)據(jù)殺熟”指在線旅游經(jīng)營者利用大數(shù)據(jù)等技術(shù)手段,針對不同消費特征的旅游者,對同一產(chǎn)品或服務(wù)在相同條件下設(shè)置差異化的價格(varied prices for same tour product or service based on different consumers)。
違反該條規(guī)定的,由市場監(jiān)督管理部門責令限期改正,沒收違法所得(confiscate illegal gains),可以并處五萬元以上二十萬元以下的罰款;情節(jié)嚴重的,并處二十萬元以上五十萬元以下的罰款。
Agencies should also publicize the process of reserving tour packages and travel services to users to make the process more transparent.
在線旅游經(jīng)營者應(yīng)當建立透明、公開的旅游產(chǎn)品及服務(wù)預(yù)訂渠道。
不得刪除差評
針對一些平臺“刪除、隱匿差評”等問題,《暫行規(guī)定》還規(guī)定,平臺經(jīng)營者應(yīng)當保障旅游者的正當評價權(quán),不得非法刪除、屏蔽旅游者對平臺服務(wù)及其平臺內(nèi)經(jīng)營者的產(chǎn)品和服務(wù)的評價(agencies should not delete or block consumers' comments on tour products and services),不得誤導(dǎo)、引誘、替代或強制旅游者做出評價。
明確平臺的連帶責任
平臺經(jīng)營者未能對在線旅游平臺內(nèi)經(jīng)營者、旅游輔助服務(wù)者資質(zhì)進行審核(fail to examine and verify qualifications of tour service and support providers),或未能對旅游者盡到安全保障義務(wù)(fail to guarantee consumers' safety),造成旅游者損害的,依法承擔相應(yīng)責任。
此次公開征求意見截止到11月10日。
