孔夫子舊書(shū)網(wǎng)賣(mài)博士學(xué)位論文 涉清華北大等多家高校

According to a report from news portal thepaper.cn, there are some 4,000 items tagged as "doctoral dissertations" for sale on kongfz.com, which come from dozens of elite Chinese universities including Tsinghua University, Peking University and Fudan University.

據(jù)新聞門(mén)戶網(wǎng)站《澎湃新聞》報(bào)道，孔夫子舊書(shū)網(wǎng)上出售的博士論文多達(dá)4000多篇，這些論文的作者大多來(lái)自清華大學(xué)、北京大學(xué)、復(fù)旦大學(xué)等我國(guó)10多所知名院校。

The dissertations are priced from 5 - 1,000 yuan by different sellers on the website.

網(wǎng)站上不同賣(mài)家出售的論文價(jià)格為5-1000元不等。

"The website removed some works in October 2016 after our complaints. But now they are selling them again," Zhang Ming (pseudonym), who has a doctorate from Tsinghua University, was quoted by thepaper.cn as saying last Wednesday.

上周三，清華大學(xué)博士畢業(yè)生張明(化名)向《澎湃新聞》透露：“2016年10月份受到投訴之后，該網(wǎng)站下架了部分論文，但現(xiàn)在他們又開(kāi)始賣(mài)了。”

Many of the graduates, who said their dissertations are being sold without consent, added that the website is infringing their intellectual property rights and causing psychological and economic damages, said the thepaper.cn report.

據(jù)《澎湃新聞》報(bào)道，論文作者稱(chēng)，網(wǎng)站未經(jīng)他們的同意就進(jìn)行售賣(mài)，這侵犯了他們的知識(shí)產(chǎn)權(quán)，給他們?cè)斐闪诵睦韯?chuàng)傷和經(jīng)濟(jì)損失。

"We don't want our dissertations to be spread widely before our original points of view are published in academic journals or books, as there's no way to guarantee other people will not copy these ideas," Zhang added.

張明表示：“在原創(chuàng)觀點(diǎn)于學(xué)術(shù)期刊發(fā)表或以專(zhuān)著形式出版之前，我們不愿意讓自己的論文大范圍傳播，那樣可能導(dǎo)致他人的抄襲。”

"When the author hands in the dissertation to university faculties for reviews, or the graduate donates the copies to the libraries or gifts these copies to friends, the writers have already executed their publication rights", Yao Huanqing, a professor from the Law School of the Renmin University of China, told the Global Times.

來(lái)自中國(guó)人民大學(xué)法學(xué)院的姚歡慶教授在接受《環(huán)球時(shí)報(bào)》采訪時(shí)表示：“在將論文交給學(xué)校評(píng)審或捐贈(zèng)給圖書(shū)館、或送給朋友時(shí)，作者就已經(jīng)在行使他們的出版權(quán)了。”

"If the sellers on the kongfz.com got these copies from the above mentioned sources, then the copies cannot be considered as pirated."

“如果孔夫子舊書(shū)網(wǎng)通過(guò)上述途徑得到了論文，那么這些論文就不為作者個(gè)人所有了。”

Unless the authors can prove that these copies are pirated, they cannot demand the shop owners to stop selling the copies, and the sellers could set the price according to their discretion, Yao said, adding that the owners do not have a duty to explain how they got these copies either.

姚歡慶教授稱(chēng)，除非作者可以證明論文是其個(gè)人所有，否則他們無(wú)權(quán)要求網(wǎng)站店主下架論文，店主就有權(quán)對(duì)論文進(jìn)行定價(jià)，也無(wú)需解釋他們是如何獲得這些論文的。
